Terms and Conditions

Please read these Terms and Conditions carefully as they affect your rights and liabilities under the law. Together with our website prices, delivery details, contact details, Refund Policy and Privacy Policy, they form the whole of the agreement between us relating to the supply of goods to you.

By using tuktukmart.co.uk (the "Website") and/or placing an order with us, you agree to these Terms and Conditions. If you do not agree with them, please do not use the Website.

We may change these Terms and Conditions from time to time. Any change takes effect once posted on the Website. The version that applies to your order is the one in force at the time you place it.

These Terms and Conditions do not affect your statutory rights as a consumer.


Definitions

In these Terms and Conditions:
"we", "us", "our" means Tuk Tuk Mart Ltd, a company registered in England, trading as Tuk Tuk Mart, whose address is 58–60 George Street, Manchester, M1 4HF.
"you", "your" means the person using the Website or placing an order.
"Website" means tuktukmart.co.uk, as operated by us.
"working day" means any day other than a Saturday, Sunday or bank holiday in England and Wales.


1. Using our Website and your account

1.1 You must be at least 18 years old to place an order.
1.2 You may check out as a guest or create an account. If you create an account, you are responsible for keeping your login details secure and for all activity under your account.
1.3 You must make sure the details you give us are accurate, and update them if they change.


2. Pricing and product availability

2.1 Where applicable, prices shown on the Website include VAT but exclude delivery charges, which are shown at checkout before you pay.
2.2 Prices and product availability may change without notice.
2.3 We try to make sure all prices and descriptions are accurate, but errors may occur. If we discover an error in the price of goods you have ordered, we will contact you as soon as possible to ask whether you wish to continue at the correct price or cancel. If we cannot reach you, we will treat the order as cancelled and refund any payment in full.


3. Your order

3.1 Your order is an offer to buy from us. A contract is formed only when we send you an email confirming that your order has been dispatched — not when you receive an order acknowledgement.
3.2 We may refuse or cancel an order at any time before dispatch, including where goods are unavailable, where we cannot obtain authorisation for payment, or where we suspect fraud. If we cancel, we will refund any payment you have made for that order.


4. Payment

4.1 We accept payment through the methods shown at checkout, including major credit and debit cards and other online payment options offered on the Website. We do not accept payment by cash or cheque.
4.2 Goods with age restrictions may require age verification and may only be paid for by card.
4.3 By completing checkout, you authorise payment through our online payment facility. Payment is normally taken once your order has been checked.
4.4 You become the owner of the goods, and risk passes to you, on delivery.


5. Delivery

5.1 Orders are normally processed within 1–7 working days of receipt, subject to payment being received and depending on the delivery option chosen. The dispatch estimate for your order is shown at checkout.
5.2 Actual delivery times may vary due to high demand or circumstances outside our control.
5.3 Orders placed after 11am, or on a day that is not a working day, are processed on the next working day.
5.4 Orders placed on a Friday using an overnight service are not dispatched until the next working day.
5.5 Goods are delivered to the shipping address you provide at checkout. Please make sure it is correct.


6. Your right to cancel (cooling-off period)

6.1 If you are a consumer buying online, you have the legal right to cancel your order and receive a refund under the Consumer Contracts Regulations 2013. You may cancel from the moment you place your order up to 14 days after the day you receive your goods, without giving a reason.
6.2 To cancel, tell us clearly by email at enquiries@tuktukmart.co.uk or by post at the address below, quoting your order number.
6.3 After telling us you wish to cancel, you must return the goods within 14 days. Unless the goods are faulty or not as described, you are responsible for the cost of return postage.
6.4 We will refund you within 14 days of receiving the goods back (or of receiving proof that you have sent them). We may reduce your refund to reflect any loss in value caused by handling beyond what is necessary to check the goods.
6.5 Exceptions. By law, the 14-day cooling-off right does not apply to: perishable goods, including fresh, chilled and frozen food and drink, which by their nature may deteriorate quickly; and sealed goods that are not suitable for return for health or hygiene reasons once unsealed. This does not affect your rights if such goods arrive faulty, damaged or not as described.


7. Returns and exchanges

7.1 In addition to your cancellation right above, you may return unopened, non-perishable items in their original, resaleable packaging within 14 days of delivery for exchange or refund.
7.2 We cannot accept returns or exchanges of fresh, chilled or frozen items, or of opened items, unless they are faulty.
7.3 Returns and exchanges must be authorised by us first. Please contact us at enquiries@tuktukmart.co.uk before sending anything back.
7.4 For change-of-mind returns and exchanges, you are responsible for the return postage cost.


8. Faulty, damaged or spoiled goods

8.1 Under the Consumer Rights Act 2015, goods must be as described, fit for purpose and of satisfactory quality.

8.2 If the goods you receive are faulty, damaged, spoiled, not as described, or the wrong quantity, please tell us by email or telephone as soon as you can, and include a photograph where possible. For fresh, chilled and frozen items, please contact us within 24 hours of delivery. For all other items, please contact us within 14 days of delivery.

8.3 Telling us quickly helps us put things right, and it lets us see perishable items close to the condition they arrived in. Please keep the item where you can, and do not throw it away until we have been in touch. If you come to us later than the times set out above, please still contact us. We consider every report on its facts.

8.4 We will put things right, by replacing or repairing the goods, or by providing a full or partial refund, including any return postage costs where the goods are faulty or not as described.

8.5 If you have not received goods you ordered, please contact us so we can investigate with our delivery partner.

8.6 Nothing in these terms affects your statutory rights. Where goods are not of satisfactory quality, the Consumer Rights Act 2015 gives you a short-term right to reject them. For goods that perish sooner, that period is the period the goods can reasonably be expected to last.


9. Out of stock products

9.1 We try to keep our stock levels accurate, but they are not updated in real time, so an item may sell out while you are ordering. If this happens, we will contact you to arrange a replacement, a delayed dispatch, or a refund for the affected item.


10. Complaints

10.1 We aim to provide good service at all times. If you are unhappy with any part of our service, please put your complaint in writing to us by email or post.
10.2 We will look into your complaint and let you know our findings and any action we propose to take.


11. Liability

11.1 We will not be liable to you for any indirect or consequential loss (including loss of profits, business or goodwill) arising from a problem you notify to us under these Terms.
11.2 Our total liability to you in connection with any order will not exceed the amount you paid for the goods in question.
11.3 You are responsible for complying with any laws that apply to importing goods you buy from us. Some goods may not be exportable to certain countries.
11.4 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited or excluded. Nothing in these Terms affects your statutory rights as a consumer.


12. Force majeure

We are not liable for any failure or delay in delivering goods, or any damage or defect caused by events outside our reasonable control, including strikes, breakdown of systems or networks, flood, fire, explosion or accident.


13. Notices

Unless stated otherwise, all notices from you to us must be in writing and sent to Tuk Tuk Mart Ltd, 58–60 George Street, Manchester, M1 4HF, or by email to enquiries@tuktukmart.co.uk. Notices from us to you will be sent to the details you provided or displayed on the Website.


14. Privacy

Your use of the Website is also governed by our Privacy Policy, which explains how we handle your personal information.


15. General

15.1 If any part of these Terms is found to be unenforceable, the rest will remain in force.
15.2 A person who is not a party to this agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term, but this does not affect any right or remedy that exists apart from that Act.
15.3 These Terms set out the whole agreement between us relating to the supply of goods. Save for fraud, we are not liable for any representation not set out in these Terms.


16. Governing law

These Terms and any contract between us are governed by English law, and the courts of England and Wales have jurisdiction to resolve any dispute.
